The Second Ecumenical Council of Lyons in Canon 3 declares: That we may, so far as possible, put and end to malice in the matter of elections, postulations, and ecclesiastical collations, lest a prolonged vacancy prove dangerous to the Churches, or the collation of dignities and other ecclesiastical benefices be delayed, we decree that it as times some object to elections, postulations, or collation, or by finding fault in the form of the election, postulation, or collation, or with the person of the one to whom a benefice is to be given or has already been given, and on this account happen to appeal, those who make the appeal must state in a public document of in letters and in the presence of an authorized person or persons who must bear witness to the truth in the matter, everything to which they intend to object in the matter of form or persons, and they must take an oath that they believe those things which they expressed in the document are true and that they can prove them.
Canon 1622: Whenever the oath is taken either by the judges, or the officials of the court, or the litigants, witnesses, or experts, it must always be taken under the invocation of the Divine Name, priests meanwhile touching their breasts and laymen touching the Book of the Gospels.  In administering the oath to the litigants, witnesses and experts, the judge shall regularly remind them of the sacredness of the act, or the very serious nature of the crime of perjury, and of the penalties to which one becomes liable who, after being sworn, tells a falsehood in court.  The oath shall be taken according to a formula approved by the judge, shall be taken in the presence of this judge or his delegate, and in the presence of both or either of the parties, if they desire to be present when the oath is tendered.
Facts of the Case:
1. On July 16, 1990 David Allen Bawden was elected to the Papacy and took the name of Michael.
On March 25, 2009 Pope Michael solemnly declared this fact in due Canonical Form.
This fact was also solemnly declared on July 17, 1990.
2. Many accepted this election as valid and confirmed it by fulfilling the order of Pope Michael in 1992 by making their Profession of Faith in due canonical form in the presence of Pope Michael, including all the participants in the election on July 16, 1990.
3. None have made a claim against the validity of the Papal Election in the proper canonical form as reuqierd by the Second Council of Lyons.  (See above)
4. On March 30, 2007 Teresa Benns, one of the electors in 1990, tendered her Letter of Withdrawal from the Catholic Church
5. Although this letter and accompanying notebook mention alleged heresies of Pope Michael, none were ever proven in either document.  The notebook foremd the basis of Teresa benns website from June 2007 until July 2008.  (Note Teresa's website will not be linked, because some fo the information is heretical, other erroneous and other factually incorrect.)  Also once something is refuted, often it disppears only to be replaced by a new allegation and/or theory. 
6. Pope Michael challenged the accuracy of factual claims found on Teresa Benns' website and she removed the entire website as requested.
7. Teresa Benns relauches her website with new information.  Some of which is also erroneous.
8. Teresa Benns makes statement that claim Pope Michael has not addressed certain issues, when no attempt at direct contact by mail or email or in any other manner has even been attempted. Therefore Pope Michael considers this publication is sufficient in the eye of Benns and others who repeat similar claims.  (Anyone coming to this page is requested to contact these people and inform them of this webpage and its claims.
9. Pope Michael directly contacted Benns and notified of her duty as required by Canon Law (quoted above), in the manner she requested in addition to email.
